On September 11, AmCham’s AccessUSA held a seminar on ‘Global Enforcement of U.S. Anticorruption Law,’ focusing on the U.S. Department of Justice’s tightened enforcement of its Foreign Corrupt Practices Act.

Global enforcement of the U.S. anticorruption laws is now multi-jurisdictional and comprehensive - and it has never been as active and well supported from other jurisdictions, including EU, as it is today. Therefore it is particularly important that companies understand what is expected of them before a problem arises, including developing a comprehensive compliance plan that is documented throughout the organization.

Speakers included Washington D.C.- based lawyer and partner at Foley & Lardner, Scott Fredericksen, who focused on the long arm of the U.S. Department of Justice in corruption cases. Mr. Fredericksen cited examples from European companies that have been caught under the new law tightening, and discussed the benefit of voluntarily disclosing breaches as soon as they occur, in order to avoid criminal punishment.

Kromann-Reumert Partner and corporate compliance expert Hans Jakob Folker focused on the European and Danish perspective of the U.S. law enforcement, highlighting how the best outcome would be a single global settlement, in order to avoid ‘double jeopardy’ – or multiple penalties across several jurisdictions.
